The defendants applied for summary judgment on the claimant's claim to enforce a Russian judgment increasing the amount of damages awarded under a much earlier russian judgment that had already been satisfied.

Floyd J held that there had been a plain breach of finality principle, a principle of public policy recognised by both English law and article 6 of the ECHR and gave judgment for the defendants.
