Brown v Executors of HM Queen Mother and HRH Princess Margaret

[2008] WTLR 425

Court: Court of Appeal
Date of Judgment: 17.10.07
Frank Hinks QC, Jonathan Adkin QC

A Jersey accountant, Mr Brown, believes that he is the son of the late HRH Princess Margeret and applied for the unsealing of the wills of HM Queen Elizabeth, The Queen Mother and HRH Princess Margaret on two grounds : the first on the basis that he is the son of HRH Princess Margaret and the second on the basis of the public interest in making the wills open to inspection.

Frank Hinks QC and Jonathan Adkin acted for the Executors of both HM Queen Elizabeth The Queen Mother and HRH Princess Margaret on their application to strike out both grounds of claim. Such application was successful before the Presdient of the Family Division. On Mr Brown's appeal the strike out of the claim based on his asertion that he is the son of HRH Princess Margaret was upheld, but his claim on the basis of the public interest was allowed to proceed to trial.
