Golfrate v Aziz

[2009] EWCA Civ 250

Court: Court of Appeal
Philip Marshall QC

Philip Marshall QC led Daniel Lightman for the Claimant, a decision of Sir Donald Rattee on the propriety of awarding security for costs in relation to a claim brought by an Isle of Man holding company with an Angolan operating subsidiary (being the largest supermarket chain in Angola).  The case involved an analysis of the significance of a bank guarantee and the ability to meet a costs award timeously if made.  An application to amend the pleadings went to the Court of Appeal (2009 EWCA Civ 250).
