Re The F Trust

The corporate trustee of a Jersey trust decided that the trust should be wound up with the assets being distributed among certain of the beneficiaries in particular proportions.  One of the beneficiaries, K, objected to the size of her share as determined by the trustee.  The trustee made an application to Court for approval of its decision and the application was opposed by K.  Subsequently, K amended her pleading so as to introduce breach of trust claims against the trustee.  K also argued that the trustee ought to be removed from office.  The matter then proceeded as contested litigation until shortly prior to trial, when a negotiated settlement was reached.  The trustee subsequently applied to the Court for approval of the settlement.  The Court granted approval and also acceded to an application that its judgment be fully anonymised.
