Roberts v Swangrove Estates Ltd and Others

[2007] EWHC 513 (Ch); Lindsay J

Court: High Court
Date of Judgment: 14.03.07
Thomas Braithwaite

Successful claim by the Crown Estate Commissioners to adverse possession of the bed of the River Severn.

First recorded domestic claim by the Crown for adverse possession since 1880. Probably the largest adverse possession claim by area ever to take place in England (over 100 sq km of the River Severn was in issue). The case also involved Constitutional arguments about the ability of the Crown to take possession of land from a subject.
