Where a claimant's cause of action was founded on activities in the nature of a conspiracy (in this case anti-competitive arrangements) in respect of which the claimant was able to proffer only limited particulars and evidence, the need for the claimant to have access to the oral evidence of the defendants at trial made summary judgment for the defendants inappropriate.
