Civil proceedings would not be stayed pending the resolution of related criminal proceedings in the absence of evidence that their continuation caused a real risk of serious injustice to the applicant. Non-availability of witnesses was not a sufficient reason for a stay of proceedings. These principles were consistent with Article 6 of the ECHR.
