This case involved a challenge by a person convicted of smuggling tobacco products into the UK against an order that he serve an additional sentence in lieu of payment of the tax payable on the smuggled goods.  The Criminal Court of Appeal decarled that he was liable to pay as having been an active participant in the smuggling operations and not just a driver on behalf of the organisations.
