Business and Property Courts Forum

BPC Bristol Forum will host the second seminar of its continuing series. The theme is interim relief and joinder of parties, and the event will be held at Osborne Clarke’s new offices (Halo, Counterslip, Bristol BS1 6AJ). 

Christopher Stoner KC will speak from 5:40-6:00 PM on 'What is arguable?' Consideration of the Court of Appeal’s recent decision in Unitel S.A. v Isabel dos Santos [2024] EWCA Civ 1109 and, in particular, the appropriate test to be applied by the Court when considering the grant of a freezing order as well as the appropriate approach to the costs of such applications.

5:30 – 5:40 – Chair’s address (The Honourable Mr Justice Henshaw, Judge In Charge of Commercial Court)

5:40 – 6:00 – What is arguable? 6:00 – 6:20 – Duty of full and frank disclosure: A review of recent decisions of the High Court and CoA and consideration of how applicants might best comply with their duty of candour (Apparel FZCO), what the consequences might be for failing to comply with that duty (Derma Med), and how respondents might best advance their position on the issue at the return date hearing (Mex Group v Ford & Ors) (Lottie Mallin-Martin, Guildhall Chambers)

6:20 – 6:40 – Joinder of parties in more than one capacity: Consideration of Cotham School v Bristol City Council and the issues which arise where litigants who have more than one capacity seek to be joined to proceedings in those two or more capacities separately (His Honour Judge Paul Matthews, Resident Chancery Judge of the Business and Property Courts in Bristol).
