Decisions in Gorbachev v Guriev

Niamh Herrett, with Joseph de Lacey and Jennifer Ridgway of Farrer & Co, have examined the recent High Court and Court of Appeal decisions in Gorbachev v Guriev in Private Client Business.

The Court of Appeal upheld the decision of the High Court and held that it has jurisdiction to permit service of a third-party disclosure application on a trustee outside of the jurisdiction (when the documents in question are located within England and Wales) and that service could be effected by delivering the application to the trustee’s English solicitors.
