Why Insolvency is one of the most powerful weapons in Fraud cases

Join Lance Ashworth QC (Serle Court) and Rachel McCahill (Head of Buckles’ Restructuring, Turnaround & Insolvency Team) on Tuesday 6 September at 10am for a joint webinar titled 'Why Insolvency is one of the most powerful weapons in Fraud cases'.

Lance and Rachel will look at how provisions within the Insolvency Act 1986 can be used as advantageous litigation tools in fraud actions. This will take into consideration s.234-236 of the Insolvency Act 1986, including inquiries into Company’s dealings, and transactions defrauding creditors, as well as the wide powers under s.423-425 of the Act.  

They will consider:

  • Gaining knowledge to reconstruct the activities of an insolvent company
  • Who to question and why
  • How best to best use that knowledge
  • How to attack transactions entered into by the insolvent company
  • The case law on:

         -Commerciality
         -Totality of a transaction
         -Security
         -Who can sue
         -Limitation
         -Extra-territoriality
