Serle Court is emerging as a leading chambers in Competition and Regulatory law, with Conor Quigley KC and Professor Suzanne Rab, in particular, having extensive experience in EU and UK competition law regulating cartels, abuse of dominance, mergers and State aid as well as regulatory law (including public procurement law) across a range of sectors including, airlines, diamonds, energy, financial services, gas, healthcare, media, motor vehicles, pharmaceuticals, telecommunications, transport, waste recycling and water.
Conor Quigley KC has appeared in proceedings before the European Courts, the House of Lords, Supreme Court, Court of Appeal and High Court, as well as the European Commission and the Office of Fair Trading. He is also a Research Fellow at the University of Oxford’s Institute of European and Comparative Law.
Professor Suzanne Rab has two decades of experience advising on competition and regulatory law, including in proceedings before the UK competition and regulatory authorities, the European Commission. Suzanne is Professor of Commercial Law at Brunel University London and also a Visiting Fellow at Imperial College, London, specialising in the interface between intellectual property and antitrust. Suzanne’s previous roles include experience as a solicitor and director working within the economics practice at PricewaterhouseCoopers.
State aid and public procurement: Conor Quigley KC is widely regarded as the leading expert at the Bar on EU State aid law and is the author of the highly acclaimed European State Aid Law and Policy (3rd edition, 2014, Hart Publishing and Bloomsbury Professional). He currently advises major international and multinational companies, as well as governmental and municipal authorities, on matters including subsidies to airlines and airports, bank restructuring following the credit crisis, and urban transport and internet communications. Suzanne Rab has considerable experience of both State aid and public procurement, in particular advising on their application to purchasing by energy and utilities companies.
Competition law: Conor Quigley KC has been involved in several major proceedings, including claims for damages, alleging breach of EU, UK and Irish competition law concerning inter alia diamond distribution, gas infrastructure, pharmaceuticals and telecommunications. Professor Suzanne Rab’s work includes cartel regulation, commercial practices, IP exploitation and merger control, advising governments, regulators and businesses across the regulated sectors including in the communications, energy, financial services, healthcare/ pharmaceuticals, TMT, transportation and water sectors.
Members of Chambers provide advice on the development, implementation and application of new competition laws and regulatory regimes in line with international best practices, including in emerging markets. Suzanne is the author of Indian Competition Law, an International Perspective (first published by Wolters Kluwer, May 2012; with a supplement on cartel regulation published in January 2013). She is co-author of Media Ownership and Control: Law, Economics and Policy in an Indian and International Context (forthcoming in Hart Studies in Competition Law in 2014). Conor Quigley QC and Suzanne Rab are co-authors of "Hong Kong Competition Law" (Hart/Bloomsbury, 2016).

Riverside Truck Rental:
Professor Suzanne Rab represented Riverside Truck Rental in parallel proceedings in the Technology and Construction Court (TCC) and the Administrative Court for judicial review. The claim raised EU and procurement law questions arising out of the conduct of a public procurement procedure subject to the requirements of the Public Contracts Regulations 2015 (SI 2015/102) (PCR 2015) and related duties arising under EU law. The case raised novel issues of law including consideration of when judicial review claims can be brought where there is a statutory procedure.
Secretary of State for Health v Servier Laboratories Ltd [2020] 3 WLR 1207:
David Drake appeared for the successful respondents in the Supreme Court hearing Secretary of State for Health v Servier Laboratories Ltd [2020] 3 WLR 1207, where it was held that the EU law principle of absolute res judicata arising from decisions of the European Courts annulling acts of EU institutions could not be applied in a legal context detached from the annulling judgment.

Michael Edenborough KC and David Drake are two of the four counsel acting for the SoS in this claim to recovery the monopolistic profits made by Servier based upon its invalid patent for perindopril (an ACE inhibitor used to combat high blood pressure). Part of the claim involves an allegation that SErvier improperly obtained a European Patent by deceiving the EPO as to the allegedly novelty of the invention. There is satellite litigation before the CJEU on the competition aspects and various issues concerning the disclosure being purported prevented by the French criminal code.
