In an article for Lexis Nexis, Niamh Herrett discusses the recent decision of the Court of Appeal in Easygroup Ltd v Easy Live (Services) Ltd and others [2023] EWCA Civ 1508. The judgment provides a much needed examination of the recognised heads of damage for the tort of passing off which now unequivocally includes damage to a claimant’s existing or prospective licensing/endorsement business.
