Wilson Leung writes in New Law Journal on a recent Hong Kong judgment clarifying committal proceedings

Writing in New Law Journal, Wilson Leung discusses the Hong Kong Court of Final Appeal’s recent decision in Chu Kong v Sun Min [2022] HKCFA 24, where Lord Neuberger held that a party is not required to seek consent from or even inform the Secretary for Justice (the equivalent of the Attorney-General) before bringing criminal committal proceedings. He highlights how this provides welcome clarity on the matter, and removes a potential anomaly between criminal contempt proceedings and civil contempt proceedings.
