CITMA Webinar – The Perils of Co-Existence Agreements

Michael Edenborough QC will be speaking at a webinar organised by The Chartered Institute of Trade Mark Attorneys – CITMA. The session takes place from 12:30pm to 1.30pm on Wednesday, 10th February 2021. 

Michael will take you through the different types of Co-existent agreements, and the IP involved to help you with drafting and troubleshooting.

As the marketplace for trade marks becomes ever more crowded, concerned traders are looking more often to protect their position with co-existence agreements to avoid potential conflicts with other traders using similar signs to their own marks.

However, in reality, co-existence agreements are no such thing; they are, in fact, separation agreements that delineate how the parties can live apart without conflict, rather than trying to live together in constant tension. The potential pitfalls are numerous, including contracting with the wrong party and forming an agreement that cannot be enforced because it is anticompetitive. In simple cases, they are redundant, and for complex cases, they too often fail to consider the future and so merely put off the evil day of litigation.

And so, as Nancy Regan said in a different context “Just say NO”.
