BUCKLESconnect Webinar: 1975 Act claims and entitled children

On Wednesday 4th May at 12 noon (UK time), Constance McDonnell QC will be speaking at a BUCKLESconnect webinar on '1975 Act claims and entitled children'.  BUCKLESconnect is a bespoke service for law firms and other professionals which provides access to legal expertise in niche areas with 300 members nationally.

This one-hour webinar will review recent judgements surrounding the (Provision for Family and Dependants) Act 1975 and how drafting and execution needs to adapt to best support entitled children.

It will consider:

  • The original purpose of the Act
  • The impact of cases such as Hirachand v Hirachand and Ilott v The Blue Cross / Mitson
  • Recoverability of CFA success fees
  • Tips for Executors and Personal Representatives to avoid litigation.

Constance has a traditional Chancery practice specialising in contentious probate, trust disputes, 1975 Act claims, administration of estates, and removal of personal representatives. She has appeared in a number of highly publicised High Court cases, including Schrader v Schrader (a successful probate claim based on undue influence), Re Smith (concerning capacity to make a lifetime gift) and, most recently, Reeves v Drew (a successful probate claim to set aside a will made by a wealthy illiterate testator). In 2016-17 she was Junior Counsel for the Respondent in the landmark 1975 Act case of Ilott v The Blue Cross in the Supreme Court. Constance acted for the successful respondent in the important case of Hirachand v Hirachand, in which the Court of Appeal determined in October 2021 that a CFA success fee can be recoverable as part of an award under the 1975 Act.
