FP Redhill Ltd v Patel & Others

Stephanie Thompson and Andrew Gurr have secured a decisive victory for the Claimants, who invested £20 million in UK property development projects, in FP Redhill Ltd v Patel & Others. The Claimants' directors dishonestly diverted funds for the benefit of themselves and connected parties, under cover of fabricated commissions, a sham planning scheme, and the payment of sums to a construction contractor. Following a 17-day trial and extensive cross-examination, in a 124-page judgment the defendants have been found liable for unlawful means conspiracy and dishonest assistance of the directors' breaches of fiduciary duty. The trial followed substantial interlocutory battles in which the Claimants obtained orders for Norwich Pharmacal relief.
