AI-Driven Fake Evidence Could ‘Play Havoc’ In Legal Disputes by Law 360
In a recent analysis piece from Law360 UK, Joanne Faulkner looks into how a recent High Court judgment exposed how non-existent artificial intelligence-generated citations had been used in legal arguments — but experts say this could be the tip of the iceberg for increasingly sophisticated fake evidence making its way into disputes. Lawyers are increasingly alive to the risks of AI-generated evidence that is becoming indistinguishable from its non-AI counterparts.
Quoting Gareth Tilley during his panel 'The rise of fake disputes' at London International Disputes Week 2025 that took place days before the ruling, saying that it was a "sorry state of affairs" that lawyers were using generative AI tools to produce written legal arguments or witness statements which are not then checked, leading to false information being put before the court.
