Rob Mundy KC has a wide-ranging commercial practice and has particular expertise in company, insolvency, contract and commercial fraud disputes. He tends to be instructed in high-value and complicated litigation. He has been consistently recommended in Chambers & Partners and Legal 500.
Rob is an experienced trial advocate, who enjoys oral advocacy and cross-examination, particularly in document-heavy and complex cases. His advocacy was described in the 2026 Chambers UK Bar Guide as “calm, measured and well-prepared”.
Rob is often engaged at the pre-action stage, being described in the 2026 Legal 500 as “a go-to for high-value complex corporate disputes where strategy is key to unlocking the case”.
Rob is a practising mediator and also sits as a Recorder of the County Court.
Rob is well-known for his expertise in company law, particularly shareholder and boardroom disputes. In the 2025 Legal 500 he was described as “a corporate barrister par excellence who can be trusted with bet-the-company shareholder litigation”. He deals regularly with unfair prejudice petitions, earn-out disputes and warranty claims.
Rob’s complementary expertise in High Court employment disputes make him particularly well suited to disputes over good-leaver status and disputes involving employee competition issues (e.g. breach of confidence).
Rob is regularly instructed by insolvency practitioners and directors in difficult insolvency-law litigation. The 2026 Chambers UK Bar Guide described him as “noted for his expertise in claims brought against directors”.
Rob is often instructed in commercial fraud cases, both for claimants and defendants, and particularly in cases involving a company-law or insolvency-law overlap. He is an experienced trial advocate and cross-examiner, and experienced in prosecuting and defending applications for freezing injunctions and other interim relief. The 2026 Chambers UK Bar Guide noted that he “receives praise for his thoughtful, measured approach and impressive advocacy style”.
Rob’s parallel company law expertise and prior employment-law experience makes him well suited to cases involving fraud by (or allegations of fraud by) directors and senior employees.
Rob enjoys the variety and challenge of acting as a mediator. He appreciates that mediation is no panacea, but believes that, if approached with energy, determination and an open-mind, mediation can lead to sensible resolutions of most disputes.
Rob acts in High Court employment proceedings concerning directors and senior employees, including disputes about restrictive covenants, confidential information and unlawful competition. Rob previously had a busy employment tribunal practice and is able to act where there are overlapping High Court and employment tribunal claims. A recent such case was Syspal Capital v Truman [2025] EWCA Civ 469, [2025] 2 BCLC 614, in which the Court of Appeal determined the proper interpretation of pre-emption provisions applying to a departing employee shareholder.
