ThoughtLeaders4 Disputes: Funding Litigation Against Financial Institutions & Big Corporates in 2024 – Issues For Your Radar

Jonathan McDonagh will be joined alongside Charlie Rooke (Burford Capital) and Jeremy Evans (Pogust Goodhead) for ThoughtLeaders4 Disputes: Funding Litigation Against Financial Institutions & Big Corporates in 2024 – Issues For Your Radar online event, taking place on Monday, 19th February from 12:00 pm (UK time).

Jonathan is a commercial chancery junior specialising in complex and high-value litigation in the fields of private client, company, civil fraud, and general commercial disputes.

In recent years, Jonathan has been instructed in some of the most high-profile pieces of litigation before the English courts, including Pakistan v Prince Muffakham Jah (the Hyderabad Fund dispute) and Munícipio de Mariana and oths v BHP Group (the Fundão Dam disaster litigation). There is an international dimension to much of Jonathan’s work, and he is frequently instructed to provide advice in respect of matters proceeding overseas as well as in this jurisdiction.

New opportunities for claims against financial institutions and corporate giants continue to arise, fuelled not least by an increased focus on ESG issues and new classes of financial assets. There continues to be a strong appetite for funding group actions among funders who see the potential for substantial returns. However, parties and funders have also had to adapt to a changing landscape arising from the PACCAR decision, developing case law on the scope of representative actions, and an increasingly crowded marketplace. What are the opportunities and dangers that await funders in 2024? Have funding models changed? This session explores these broad themes and, in particular:

  • What is driving class actions against financial institutions and big corporates?
  • Will crypto-related claims take off in 2024?
  • What are the pros and cons of portfolio-level funding?
  • How do funders anticipate and approach difficulties of enforcement?
