Trust and Insolvency Webinar

Matthew Morrison has put together an on-demand event discussing Trusts and Insolvency.

The first part of the talk discusses the operation of insolvency principles in the context of trusts, including creditors' abilities to bring claims by way of subrogation in respect of the trustee’s indemnity from the trust fund, and the manner in which a “winding up” regime may be affected using an application for directions. The second part looks in greater detail at the Z Trust and Investec v Glenalla litigation in the Channel Islands from which conjoined appeals will be heard in the Privy Council in June 2021. These cases involved consideration of the complex issues that arise in terms of priorities between creditors and trustees and the operation of a trustee’s lien in an insolvency context.
