Commercial Series II: Fiduciary Duties in Commercial Contexts

Over the next year, members of Serle Court will be delivering a series of seminars focusing on recent developments in different areas of commercial litigation, and how these developments affect clients and practitioners. The series includes seminars on Share Sale Disputes, Fiduciary Duties in Commercial Contexts and Private International Law.
The second seminar in the series, titled Fiduciary Duties in Commercial Contexts, is taking place on Wednesday 8 May 2019. The session will be chaired by Elizabeth Jones QC. The panel speakers, Zoe O'Sullivan QC, Gareth Tilley and Zahler Bryan will speak about the following subjects:
- the exercise of the Braganza discretion in the commercial context;
- the relationship between fiduciary duties and duties of good faith post-Braganza v BP Shipping; and
- the recent Court of Appeal decision in Medsted Associates Limited v Canaccord Genuity Wealth (International) Limited [2019] EWCA Civ 83: secret commissions and the limited to the scope of an agent's fiduciary duty.
