Insolvency in International Litigation
Location: Serle Court, 6 New Square, Lincoln's Inn, WC2A 3QS
Following the success of our first 'Morning Brief: Insolvency Insights' breakfast seminar, a series brought to you by our insolvency experts, we are pleased to announce our next session. On Thursday, 4 December, James Mather and Wilson Leung, chaired by Lance Ashworth KC, will discuss Insolvency in International Litigation.
James and Wilson will explore strategies, tactics and complications related to enforcing an overseas judgment by way of an English insolvency process. Discussion points will include:
- The Court of Appeal’s decision in Drelle v Servis-Terminal – what does it mean and did the court get it right? Does it extend to both corporate and personal insolvency? Have offshore jurisdictions adopted the same approach?
- What are practical strategies for dealing with Drelle’s impact?
- What is the impact of appeal avenues in the overseas jurisdiction and what other potential obstacles to recognition commonly arise?
- What is the significance of ongoing events in the overseas jurisdiction even after recognition?
- Lessons learned by James and Wilson from their involvement in State Bank of India v Mallya, Invest Bank v El-Husseini, and Zhang v Eternity Sky.
