Mind the Gap: Common Errors in Insolvency Applications and How to Avoid Them

We are excited to announce the launch of 'Morning Brief: Insolvency Insights', a series of breakfast seminars brought to you by our insolvency experts. These will be held in chambers, once a month and will run into the new year. 

Kicking off our first session of this series, Matthew Morrison KC and Tim Benham-Mirando, chaired by Lance Ashworth KC, present: ‘Mind the Gap: Common Errors in Insolvency Applications and How to Avoid Them’. 

Matthew and Tim will explore a number of pitfalls which may arise in insolvency applications and identify how they can be sidestepped. These will include:

  1.  avoiding petitioning for bankruptcy and winding up on the wrong sorts of debts; 
  2.  navigating issues arising from foreign judgments and foreign law, and taking account of jurisdictional considerations; 
  3.  identifying and addressing tactical questions such as electing between personal/corporate targets, and personal/proprietary claims; 
  4.  presenting concise, compelling and compliant evidence and effectively challenging improper evidence from the other side; and 
  5.  successfully litigating wrongful trading claims, taking account of the learnings from the BHS litigation.
