Serle Court & Maples Group are pleased to launch the second session of Cross-Border Private Client & Trusts webcasts. The second panel focuses on Anti-Bartlett Clauses. 

This session chaired by Maples London Partner, Ray Davern and presented by panellists Richard Wilson QC (Serle Court), Matthew Morrison (Serle Court), and Alex Way (Maples Group), will discuss the following topics: 

  • The English law background to, and the perceived need for, anti-Bartlett clauses.
  • Analysis and discussion of the Zhang Li v DBS decision of the Hong Kong Court of Final Appeal upholding a well-drafted anti-Bartlett clause under Jersey law.
  • Discussion of the different types of anti-Bartlett clause (exclusion of duty vs power to intervene), whether all trusts should include an anti-Bartlett clause of some description and pitfalls for trustees administering trusts subject to anti-Bartlett provisions. 

The panels are a virtual series of debate-style sessions addressing topics that are both current and controversial in the trusts industry in 2021. The series of webcasts will be of interest to lawyers, attorneys and solicitors (both onshore and offshore), trust management specialists and trustees.
