#SerleShare - Andrew Francis discusses the Supreme Court judgment in Alexander Devine Children’s Cancer Trust v Housing Solutions Ltd [2020] UKSC 45

#SerleShare – Following the recent decision of the Supreme Court in Alexander Devine Children’s Cancer Trust v Housing Solutions Ltd [2020] UKSC 45, Serle Court’s Andrew Francis discusses what we can learn from the judgment.

In this SerleShare, Andrew looks at what can be learnt from this unusual and exceptional case, given that it is almost unheard of  for an applicant to make an application to the UTLC under s. 84(1) Law of Property Act 1925 when the applicant’s development is completed, even after warnings about breach have been given by the beneficiary of the covenants.

Andrew Francis is author of ‘Restrictive Covenants and Freehold Land - a Practitioner’s Guide’ 5th Edn. published in 2019 and one of the leading works on the subject in which he is a specialist.
