Judgment of the Supreme Court in Ilott v Mitson

The seminar will look at the implications of the decision in Ilott v Mitson, the first appeal in a claim under the Inheritance (Provision for Family and Dependants) Act 1975 to be heard by the Supreme Court.

It will focus on:-

  1. Maintenance - what does it mean now, including if the claimant is on benefits?
  2. Charities and litigating 1975 Act claims
  3. What weight should be given to a testator's wishes, and to the relationship between the testator and the claimant?
  4. Claims by adult children - in what circumstances can a claimant hope to succeed? What advice should a private client solicitor be giving a testator when preparing a will?
